​​​​The KHIE Consent Management Tool

​​The KHIE Consent Management tool is intended to enable the electronic exchange of substance use disorder (SUD) data protected by 42 CFR Part 2 to inform patients' treatment providers and support patients as they move between the various levels of care.  The goal is to improve care coordination between SUD treatment providers and other healthcare providers to strengthen continuity of care for patients and ease the burden for providers when obtaining consent and disclosing information.  

​Key Features of the Consent Management Tool

  • ​​Patients provide electronic signatures to opt in to share 42 CFR Part 2 protected health information.
  • ​Providers attest within the tool for their patients for whom they have signed paper consent forms on file. 
  • Patients can choose an expiration date or can choose to have the consent not expire. 
  • Patients can reverse the decision to opt in or opt out at any time.​

​​Provider Responsibilities

​​​​Providers access the consent tool through the KHIE Portal.  

  • Providers have the option to register a new consent for their patient or search for an existing consent on file.  
  • Providers can submit an additional paper form with the documented consent.
  • Providers must attest to providing patient education and verifying patient identity before registering consent.
  • When consent is submitted, users will be able to easily identify data in the KHIE Portal that's covered under 42 CFR Part 2.  That data is identified by the orange 'i' icon that's displayed beside the document that contains Part 2 information. 

Part 2 Consent is Provider-Driven​

​​​Part 2 Program Participants wishing to share Part 2 data are required to submit a Qualified Service Organization Agreement (QSOA), which enables their organizations to share Part 2 data with KHIE.  Providers obtain consent from Part 2 patients and register it through the KHIE Consent Management tool, which is available to them only after a Part 2 Program has entered into a qualified service organization agreement with KHIE.  

What does registered consent mean for the SUD patient?

​​When a patient has registered consent, any Part 2 covered data the SUD patient has consented to share will be available to view by the patient's care team which includes providers who have identified a treatment relationship with the patient by including the patient on a panel.​
